of winning will depend on the number of eligible applications received.
ALL
FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. FAILURE TO
COMPLETE THE APPLICATION AND PROVIDE TRUTHFUL AND PERTINENT INFORMATION MAY
RESULT IN DISQUALIFICATION FROM THE COMPETITION. DISQUALIFICATION IS IN THE SOLE
DISCRETION OF WHO-DT Channel 13 and Local TV
LLC.
WHO-DT
Channel 13
(“the television station”)will conduct the Florida Flyaway Contest (“the
Competition”) substantially as described in these Regulations. Participation in the Competition
constitutes each applicants’ and contestant’s full and unconditional agreement
to, and acceptance of, these Regulations.
All decisions of WHO-DT Channel
13 are final and absolute and not subject to inquiry or appeal. The Competition may be
temporarily postponed or discontinued at any time without prior notice.

BACKGROUND
INFORMATION:
By
applying for participation in the Competition, each applicant and contestant
understands that he or she may be subject to one or more background checks. Background checks will include civil,
criminal, financial, driver-history and any other type of background check
deemed necessary by designated agents of the television station. Applicants and
contestants may be required to provide additional information throughout the
Competition if deemed necessary by the
television station.
ELIGIBILITY
REQUIREMENTS:
Applicants
and contestants must be legal US
residents 18 years of age or older and reside in Des Moines/Ames television
viewing area as defined by the Nielsen Company
which includes the following Iowa counties: Adair,
Adams, Appanoose, Audubon, Boone, Calhoun, Carroll, Clarke, Dallas, Decatur,
Franklin, Greene, Guthrie, Hamilton, Hardin, Humboldt, Jasper, Kossuth, Lucas,
Madison, Mahaska, Marion, Marshall, Monroe, Pocahontas, Polk, Poweshiek,
Ringgold, Story, Taylor, Union, Warren, Wayne, Webster,
Wright.
To
be eligible to participate, each applicant must complete an entire application
package, including applicable release forms and waivers. If
a winner is disqualified, the television
station reserves the right in its sole discretion to determine an alternate
winner or to not award that winner’s prize at all. Employees of
Local TV LLC, employees of the
television station, the Contest's participating sponsors and their
advertising agencies, employees of other radio or television stations, and
members of the immediate family of any such persons are not eligible to
participate and win. The term "immediate family" includes spouses, siblings,
parents, children, grandparents, and grandchildren, whether as "in-laws," or by
current or past marriage(s), remarriage(s), adoption, co-habitation or other
family extension, and any other persons residing at the same household whether
or not related.
CONTEST
PERIOD:
The
Contest begins on Thursday, February 4,
2010 at 6 AM and ends on Wednesday,
March 3 at 9:59 PM (“the Contest Period”). The television station reserves the
right to extend the Contest Period.
CONTEST
AND PRIZE:
Each
day throughout the contest period, a “Florida Flyaway Clue” (“the clue”)
consisting for a word or phrase will be broadcast one time between 6 AM and 7 AM
Mondays through Fridays and between 8AM and 9AM Saturdays and Sundays. Entrants will have until 9:59 PM on
Wednesday nights though the contest period to visit http://whotv.com/contests, successfully log
into the contest tool and enter the clue for that day. There is no limit to the number of
entries.
At
the end of each Wednesday through the contest period, one winner will be chosen
at random from all complete and correct entries. There will be a total of four (4)
winners through the four (4) week contest period. Station reserves the right to end
registrations and draw a weekly winner prior to 10 PM each
Wednesday.
Each
winner will receive 4 round-trip tickets to Orlando International Airport from Allegiant Air. Restrictions and fees apply. Seats based on
availability.
Prize
value is $661.84.
RELEASE;
PUBLICITY; USE OF PERSONAL INFORMATION:
By
participating in the Competition, each contestant and winner waives any and all
claims of liability against Local TV LLC and its employees and agents, the television station and its
employees and agents, the Competition’s additional sponsors and their respective
employees and agents, for any personal injury or loss which may occur from the
conduct of, or participation in, the Competition. In order to participate in the
Competition, contestants must sign an official waiver form provided by the television station. By participating in the Competition, the
winner consents to the television
station and Local TV LLC’s use of his or her name, state of residence, and
likeness for advertising and promotional purposes online, for broadcast, and in
print, or in any other media worldwide in connection with the Competition,
without limitation and without additional compensation, except where prohibited
by law.
TELEPHONE
& DELIVERY DISCLAIMER:
The
television station
disclaims all liability for the inability of a participant to complete or
continue a telephone call due to equipment malfunction, busy lines, inadvertent
disconnections, acts beyond the
television station’s control,
or otherwise. The television station
disclaims all liability for any delays, misdelivery, loss, or failure in the
delivery of any item sent by mail, courier, express, electronic transmission, or
other delivery method. No photocopies or mechanical reproductions of entry forms
are permitted. The television
station is not responsible for mechanical, technical, electronic,
communications, telephone, computer, hardware or software errors, malfunctions
or failures of any kind, including: failed, incomplete, garbled or delayed
transmission of online entries, traffic congestion on telephone lines, the
Internet or at any website or lost or unavailable network connections which may
limit an online entrant's ability to participate in the Contest, and any injury
or damage to entrant's or any other person's computer related to or resulting
from participating in or downloading any information necessary to participate in
the Contest.
TAXES:
Any
valuation of the prize(s) stated above is based on available information
provided to the television station,
and the value of any prize awarded to a winner may be reported for tax purposes
as required by law. All taxes,
including federal, state and local taxes, are the sole responsibility of
winner. Any person winning over
$600 in prizes from the television
station will receive a 1099 form at the end of the calendar year and a copy
of such form should be filed with the IRS.
Each winner must provide the
television station with valid identification before any prize will be
awarded.
LIMITATION
OF LIABILITY:
By
participating, competitors agree: (a) to the Official Regulations and decisions
of the television station, which
shall be final in all respects; (b) to release, discharge, and hold harmless the television station and its
respective affiliates, parents, subsidiaries, advertising and promotion
agencies, officers, directors, employees, representatives, and agents from all
liability, injuries, losses or damages of any kind to persons, including but not
limited to death or property damage resulting in whole or in part, directly or
indirectly, from participation in the Competition or any Competition-related
activity; (c) that the foregoing parties have neither made nor are in any manner
responsible or liable for any warranty, representation or guaranty, expressed or
implied, in fact or in law, relating to any prize. The
television station,
Local TV LLC, their sponsors, and their advertising and promotion agencies are
not responsible for cancellations, postponements, or delays. The television station shall have the
sole discretion to administer the Competition and interpret and apply these
Regulations. Anyone using
fraudulent means to participate in and/or win the Competition will be subject to
disqualification. The television
station reserves the right to disqualify any contestant at any time, for any
reason, including, without limitation, language, lyrics, activities or behavior
deemed inappropriate. In consideration for entering the Competition, each
contestant and winner grants the
television station, Local TV LLC, its sponsors and its employees, agents,
subsidiaries, advertising and promotion agencies the right to use the
contestant’s name, voice, likeness and performance, and any portion thereof,
without prior notice or compensation for any purpose and in any media now known
or hereinafter devised. Such right shall be irrevocable, extend throughout the
universe and inure in perpetuity. Without limiting the generality of the
preceding sentence, the television
station and Local TV LLC shall own all rights, title and interest in and to
all performances, recordings, videos and images rendered by contestants in
connection with the Competition. Other than the prizes received by the Grand
Prize winner, no contestant shall be entitled to receive any wages, benefits,
fees or other compensation whatsoever as a result of participating in the
Competition. In consideration for his or her participation in the Competition,
each contestant agrees to release and indemnify the television station, Local TV LLC,
and the officers, directors, agents, parent companies, subsidiaries and
employees of the television station
and Local TV LLC, from any and all claims, demands and/or causes of action of
any nature or kind whatsoever, whether presently known or unknown, foreseen or
unforeseen, that arise out of the contestant’s participation in the
Competition. Any
expenses incurred by the applicant during the application process, including but
not limited to, postage, shipping and materials preparation (videotape, photos,
etc.) are the sole responsibility of each applicant and neither the television station nor Local TV LLC
will issue reimbursement for any expenses. All contestants and winners agree, by
participation in the Competition, to submit to the personal jurisdiction of the
courts of Iowa. All courts of Iowa shall govern this
Competition, without regard to Iowa’s choice of law rules. The courts of Iowa shall be
the exclusive forum for any dispute regarding any Regulation or activity
associated with the Competition.
MISCELLANEOUS:
Each
applicant and contestant agrees to abide by these Regulations. Each winner must submit proof of
eligibility and sign the television
station’s release form to claim the prize. The television station may substitute
prizes, amend rules or discontinue the Contest at any time as announced on the
Station(s). The television station disclaims any
responsibility to notify the participants of any aspect related to the conduct
of the Contest.
OFFICIAL
REGULATIONS:
To
request an additional copy of the Regulations, send a self-addressed stamped
envelope to the business offices of WHO-DT Channel 13 by March 3, 2010. Written copies of these Regulations are
also available during normal business hours at the business offices of WHO-DT Channel 13 at 1801
Grand Avenue, Des Moines, IA. All applications become property of the television station and will not be
returned.
COMPLIANCE
WITH LAW:
The
conduct of the Competition is governed by the applicable laws of the United
States of America, which take precedence over any regulation to the contrary
herein. The Competition is void
where prohibited and subject to all federal, state, and local laws and
regulations.
