Official Rules and Regulations

NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING.  Odds of winning will depend on the number of eligible applications received.

ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. FAILURE TO COMPLETE THE APPLICATION AND PROVIDE TRUTHFUL AND PERTINENT INFORMATION MAY RESULT IN DISQUALIFICATION FROM THE COMPETITION.  DISQUALIFICATION IS IN THE SOLE DISCRETION OF WHO-HD Channel 13 and Local TV LLC.

WHO-HD Channel 13 will conduct the February Flyaway (“the Competition”) substantially as described in these Regulations.  Participation in the Competition constitutes each applicants’ and contestant’s full and unconditional agreement to, and acceptance of, these Regulations.  All decisions of WHO-HD Channel 13 are final and absolute and not subject to inquiry or appeal.  The Competition may be temporarily postponed or discontinued at any time without prior notice.

BACKGROUND INFORMATION:
By applying for participation in the Competition, each applicant and contestant understands that he or she may be subject to one or more background checks.  Background checks will include civil, criminal, financial, driver-history and any other type of background check deemed necessary by designated agents of WHO-HD Channel 13. Applicants and contestants may be required to provide additional information throughout the Competition if deemed necessary by WHO-HD Channel 13.

ELIGIBILITY REQUIREMENTS:
One (1) entry per person per weekday is allowed. One winner per household through the contest period.  Applicants and contestants must be legal US residents 18 years of age or older and reside in Des Moines/Ames television viewing area as defined by the Nielsen Company which includes the following Iowa counties:  Adair, Adams, Appanoose, Audubon, Boone, Calhoun, Carroll, Clarke, Dallas, Decatur, Franklin, Greene, Guthrie, Hamilton, Hardin, Humboldt, Jasper, Kossuth, Lucas, Madison, Mahaska, Marion, Marshall, Monroe, Pocahontas, Polk, Poweshiek, Ringgold, Story, Taylor, Union, Warren, Wayne, Webster, Wright.

To be eligible to participate, each applicant must complete an entire application package, including applicable release forms and waivers.  If a winner is disqualified, WHO-HD Channel 13 reserves the right in its sole discretion to determine an alternate winner or to not award that winner’s prize at all.  Employees of Local TV LLC, employees of WHO-HD Channel 13, the Contest's participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

Daily winners are only eligible to be entered once into each weekly drawing even though they may enter every day.

Limit one weekly prize per person and per household.

CONTEST PERIOD:
The Contest begins Thursday, February 2, 2012 at 5:00 AM and ends on Thursday, March 1, 2012 at 7:00 AM (“the Contest Period”).  WHO-HD Channel 13 reserves the right to modify the Contest Period.

HOW THE CONTEST WORKS AND PRIZES:
Each weekday through the contest period (except Thursday, March 1), WHO-HD Channel 13 will give a clue between 5:00 AM and 7:00 AM.  This is the ONLY time the clue will be broadcast.   Entrants will have until 9 PM each weeknight to visit http://whotv.com/contests, successfully log into the contest application and enter the clue for that day.  Limit one entry per person per weekday.

At the end of each weekday through the contest period, one winner will be chosen at random from all complete and correct entries and will constitute a daily winner.
• The daily winners from Thursday 2/2/12 through Wednesday 2/8/12 will qualify for the weekly prize drawing on Thursday 2/9/12.
• The daily winners from Thursday 2/9/12 through Wednesday 2/15/12 will qualify for the weekly prize drawing on Thursday 2/16/12.
• The daily winners from Thursday 2/16/12 through Wednesday 2/22/12 will qualify for the daily prize drawing on Thursday 2/23/12.
• The daily winners from Thursday 2/23/12 through Wednesday 2/29/12 will qualify for the weekly prize drawing on Thursday 3/1/12.

Daily winners are only eligible to be entered once into each weekly drawing even though they may enter every day.

Limit one weekly prize per person and per household.

There will be 4 winners total in this contest…one for each weekly prize drawing.   Station reserves the right to end registration and draw a daily winner prior to 9 PM.

Each weekly prize winner will receive round-trip airfare for 2 AND 3-nights (1 Room) at one of the following destinations of the winner’s choice:

• St. Petersburg/Clearwater Beach FL  (Sirata Beach Resort or  Wyndham Garden
• Orlando, FL - Marriott World Center or Wyndham Lake Buena Vista
• South Florida - Wyndham Garden Hotel South Beach or Wyndham Deerfield Beach
• New Orleans, LA - Wyndham Garden Baronne Plaza
• Las Vegas, NV - MGM Grand, New York, New York or Luxor
• San Antonio, TX - The St. Anthony Riverwalk Wyndham
• Virginia Beach, VA - Wyndham Virginia Beach

60 days advance notice required to book travel. Travel restrictions and black-out dates apply.  Taxes, baggage, ground transportation and all other fees are the responsibility of the winner.

All prizes must be picked up at the WHO-HD Studios during normal business hours at 1801 Grand Ave., Des Moines, IA  50309.  Normal business hours are M-F 8AM to Noon and 1PM to 5PM.  Prior written permission must be received by WHO-HD in order to have another party claim a prize.  That party must a have copy of the winner’s picture ID and their Social Security number to claim their prize.

RELEASE; PUBLICITY; USE OF PERSONAL INFORMATION:
By participating in the Competition, each contestant and winner waives any and all claims of liability against Local TV LLC and its employees and agents, WHO-HD Channel 13 and its employees and agents, the Competition’s additional sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Competition.  In order to participate in the Competition, contestants must sign an official waiver form provided by WHO-HD Channel 13.  By participating in the Competition, the winner consents to WHO-HD Channel 13 and Local TV LLC’s use of his or her name, state of residence, and likeness for advertising and promotional purposes online, for broadcast, and in print, or in any other media worldwide in connection with the Competition, without limitation and without additional compensation, except where prohibited by law.

TELEPHONE & DELIVERY DISCLAIMER:
WHO-HD Channel 13 disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond WHO-HD Channel 13’s  control, or otherwise. WHO-HD Channel 13 disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. No photocopies or mechanical reproductions of entry forms are permitted. WHO-HD Channel 13 is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. 

TAXES:
Any valuation of the prize(s) stated above is based on available information provided to WHO-HD Channel 13, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  All taxes, including federal, state and local taxes, are the sole responsibility of winner.  Any person winning over $600 in prizes from WHO-HD Channel 13 will receive a 1099 form at the end of the calendar year and a copy of such form should be filed with the IRS.  Each winner must provide WHO-HD Channel 13 with valid identification before any prize will be awarded.

LIMITATION OF LIABILITY:
By participating, competitors agree: (a) to the Official Regulations and decisions of WHO-HD Channel 13, which shall be final in all respects; (b) to release, discharge, and hold harmless WHO-HD Channel 13 and its respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents from all liability, injuries, losses or damages of any kind to persons, including but not limited to death or property damage resulting in whole or in part, directly or indirectly, from participation in the Competition or any Competition-related activity; (c) that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize.  WHO-HD Channel 13, Local TV LLC, their sponsors, and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays.  WHO-HD Channel 13 shall have the sole discretion to administer the Competition and interpret and apply these Regulations.  Anyone using fraudulent means to participate in and/or win the Competition will be subject to disqualification. WHO-HD Channel 13 reserves the right to disqualify any contestant at any time, for any reason, including, without limitation, language, lyrics, activities or behavior deemed inappropriate. In consideration for entering the Competition, each contestant and winner grants WHO-HD Channel 13, Local TV LLC, its sponsors and its employees, agents, subsidiaries, advertising and promotion agencies the right to use the contestant’s name, voice, likeness and performance, and any portion thereof, without prior notice or compensation for any purpose and in any media now known or hereinafter devised. Such right shall be irrevocable, extend throughout the universe and inure in perpetuity. Without limiting the generality of the preceding sentence, WHO-HD Channel 13 and Local TV LLC shall own all rights, title and interest in and to all performances, recordings, videos and images rendered by contestants in connection with the Competition. Other than the prizes received by the Grand Prize winner, no contestant shall be entitled to receive any wages, benefits, fees or other compensation whatsoever as a result of participating in the Competition. In consideration for his or her participation in the Competition, each contestant agrees to release and indemnify WHO-HD Channel 13, Local TV LLC, and the officers, directors, agents, parent companies, subsidiaries and employees of WHO-HD Channel 13 and Local TV LLC, from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the contestant’s participation in the Competition.  Any expenses incurred by the applicant during the application process, including but not limited to, postage, shipping and materials preparation (videotape, photos, etc.) are the sole responsibility of each applicant and neither WHO-HD Channel 13 nor Local TV LLC will issue reimbursement for any expenses. All contestants and winners agree, by participation in the Competition, to submit to the personal jurisdiction of the courts of Iowa.  All courts of Iowa shall govern this Competition, without regard to Iowa’s choice of law rules.  The courts of Iowa_ shall be the exclusive forum for any dispute regarding any Regulation or activity associated with the Competition.

MISCELLANEOUS:
Each applicant and contestant agrees to abide by these Regulations.  Each winner must submit proof of eligibility and sign WHO-HD Channel 13’s release form to claim the prize. WHO-HD Channel 13 may substitute prizes, amend rules or discontinue the Contest at any time as announced on the Station(s).  WHO-HD Channel 13 disclaims any responsibility to notify the participants of any aspect related to the conduct of the Contest.

OFFICIAL REGULATIONS:
To request an additional copy of the Regulations, send a self-addressed stamped envelope to the business offices of WHO-HD Channel 13 by March 1, 2012.  Written copies of these Regulations are also available during normal business hours at the business offices of WHO-HD Channel 13 at 1801 Grand Ave., Des Moines, IA  50309.  All applications become property of WHO-HD Channel 13 and will not be returned.

COMPLIANCE WITH LAW:
The conduct of the Competition is governed by the applicable laws of the United States of America, which take precedence over any regulation to the contrary herein.  The Competition is void where prohibited and subject to all federal, state, and local laws and regulations.
